Understanding the Incorporations Act
There is an increasing amount of litigation coming before the courts, particularly claims for damages initiated by injured people seeking compensation from those responsible for the injury. Sporting clubs and community groups that may host functions or events are particularly susceptible to damages claims. They need to be adequately protected in the event of legal action being taken against them.
The Associations Incorporation Act came into force in July 1983, and with amendments in 1987, provides legal protection and other benefits for associations, sporting clubs and other community groups. Some notable cases highlight the need for such protection, and coupled with insurance, community groups can now persue their agendas relatively free from the worry of litigation.
